By using PearlPost, you agree to these Terms. PearlPost acts exclusively as a software infrastructure provider, except for the editorial content produced by PearlPost itself, such as the Trends section. We do not actively moderate or curate the content uploaded by users.
1. Eligibility
You must be 16 or older to use PearlPost. Between 16 and 18, use depends on the permission of your legal guardian, who is also the one who buys and pays for the paid plans. By creating an account or accepting these Terms, you state that you meet these conditions.
2. Third-Party Platforms and API Compliance
Our services rely on third-party APIs.
2.1. YouTube:
By using PearlPost for YouTube, you explicitly agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms) and the Google Privacy Policy.
2.2. Meta & TikTok:
Your use is subject to the Terms of Service of Facebook, Instagram, and TikTok respectively.
2.3. Suspensions:
PearlPost shall not be held liable for any bans, "shadowbans," or content strikes applied by social networks against your account.
3. Copyrights and Anti-Piracy
The User warrants they own or hold the necessary licenses for all submitted content. It is strictly forbidden to use our tools to publish or clip copyrighted third-party material without authorization. You grant us only a technical license to host, process, and transmit the content.
4. Editorial Content (Trends)
The Trends section gathers trending topics manually selected by the PearlPost team and is meant only as inspiration.
- No third-party license: showing a topic, image, or brand in the section does not grant the User any rights to music, audio, images, videos, trademarks, memes, or any other third-party material related to it.
- User responsibility: the User is solely responsible for the rights to the content they create based on the trends and for complying with each platform's rules — for example, restrictions on the commercial use of music and audio by business accounts.
- Estimates: the metrics shown are PearlPost estimates, not official platform figures (see the Legal Notice).
- Correction and removal: requests regarding the section's content can be sent to legal@pearlpost.io.
5. Link in Bio Page
Each profile may publish a Link in Bio page at links.pearlpost.io.
- The page is public: anyone with the address can see it. The User is solely responsible for the content and links they publish on it.
- Forbidden: phishing, malware, scam, or impersonation (pretending to be another person or brand) links or content, or any unlawful content.
- Addresses: some addresses are reserved and cannot be used. A released address stays reserved to the previous profile for 90 days.
- Removal: we may remove a page that violates these Terms and suspend the responsible account. A suspended account has its pages taken offline.
6. Acceptable Use
You may not: violate any laws, distribute hate speech or illegal content, engage in spam, or attempt to reverse-engineer our Platform. Violations result in immediate termination without refund, except for the right of withdrawal described in the Refund Policy.
7. Notice and Takedown (DMCA)
For copyright infringement notices, email legal@pearlpost.io with the infringing URL and proof of ownership.
8. Disclaimer of Warranties
Services are provided on an "As-Is" basis. PearlPost makes no guarantees regarding "virality", reach, or engagement metrics resulting from the use of our tools. We are not liable for lost profits due to third-party API downtimes.
9. Plans, Limits and Courtesies
- Limits: each plan has its own limits (for example, the number of profiles and posts and the storage space), shown on the pricing page. When a limit is reached, the related action is blocked until you free up room or change plans.
- Smaller plan: when you move to a plan with smaller limits, nothing you created is deleted, but new use above the limits is blocked.
- Courtesies: the PearlPost team may grant a plan without charge, with or without an end date. A courtesy ends on its date, when the team removes it, or when you buy a paid plan.
10. Pearl Tokens
Pearl Tokens are credits for using PearlPost features.
- Monthly allowance: each plan includes a monthly allowance, which may be zero. On yearly plans, the allowance is also renewed month by month.
- They do not accumulate: the leftover balance expires at each new monthly period, and also when the subscription ends, is refunded, or moves to a smaller plan.
- No monetary value: Pearl Tokens are not sold separately and cannot be exchanged for money or transferred to another account.
11. Storage
The files of your posts take up your plan's storage space. In the storage settings you can turn on the automatic deletion of the oldest posts (off by default): when a new upload does not fit, PearlPost deletes the oldest posts already published (or whose publishing ended in failure) until there is room. Scheduled posts and posts being published are never deleted by it. Deleting a post, automatically or by you, erases the post and its files only from PearlPost: we are not allowed to delete posts on the social networks, and what was already published stays there until you remove it directly on the network.
12. Payments, Plan Changes and Cancellation
- Automatic renewal: subscriptions renew automatically at the end of each period.
- Upgrade: moving to a more expensive plan is a new purchase, charged right away, with no prorated credit for the time left on the previous plan.
- Downgrade: moving to a cheaper plan applies at the end of the period already paid for; after that, you complete the purchase of the new plan.
- Failed payment: if a charge fails, access continues while the charge is retried; if it is not paid, the subscription ends.
- Cancellation: you may cancel at any time. The next renewal is no longer charged and the plan stays active until the end of the paid period, with no prorated refund of that period.
- Right of withdrawal: the purchase of a plan and an upgrade can be fully refunded within 7 days, as described in the Refund Policy, which is part of these Terms.
13. Account Deletion
You may delete your account at any time in the settings. Deletion erases the account and its content on PearlPost (posts already published stay on the networks), revokes PearlPost's access to the connected networks, and cancels the paid subscription, without a refund of the current period (except for the right of withdrawal).
14. Changes to These Terms
PearlPost may update these Terms and the other legal documents at any time. The date of the latest update is always shown at the top of each document.
- Material changes — those affecting prices, billing or cancellation rules, or the User's rights and obligations — will be announced at least 30 days in advance, by email or by a notice on the Platform.
- If the User does not agree with a material change, they may cancel their subscription before it takes effect, without penalty. The screen that asks to accept the new version also lets the User cancel the subscription.
- Changes do not apply retroactively to periods already paid for.
- Wording fixes and changes that only expand the User's rights may take effect on the date they are published.
Continuing to use the Platform after the new version takes effect means agreeing to it.
15. Governing Law
These Terms are governed by the laws of Brazil.
